Trademarks

Chime’s brand is at the heart of everything we do, and we protect it through proper use and maintenance of our Trademarks.  Chime Financial, Inc. owns several Trademarks in the US and worldwide, including, but not limited to, the marks listed below.  Note: The marks listed in all caps are registered/applied-for as word marks, covering use in any color, font, or stylization. Those images shown in black and white are registered/applied-for without a claim to color, meaning Chime’s rights extend to use of those images in any color combination.

Chime does not allow third-party use of its Trademarks without explicit written permission. This includes use by members. Referral links should not be publicized in a way that implies a business affiliation with Chime, such as by registering a domain name including CHIME (e.g. Chimereferral.com or Chime100.com), creating a social media profile including CHIME (e.g. “Chime Referrals” Instagram page), or purchasing an ad using Chime trademarks. Third-Party Trademark Guidelines

These guidelines apply to third-parties that have been granted permission to use Chime marks via written agreement with Chime.

Third-Party MUST:

  1. Use the Chime Trademarks EXACTLY as registered or applied-for with the U.S. Patent and Trademark Office. This means, for example, using “Banking the way it should be” rather than “Banking as it should be” or “Banking like it should be.”
  2. Use the Chime Trademarks with the proper trademark symbols.

For registered trademarks like CHIME and SPOTME, you should use the trademark registration symbol ® in superscript (in the top right) next to the mark in the first, most prominent use, for example:

  • at the top of a website page
  • at the top of an email
  • in the profile description for any social media pages
  • in the end card of a commercial
  • at the top of any printed materials
  • next to the logo on any swag

For pending trademarks, the ™ symbol should be used. Both the ® and the ™ should be displayed in superscript at the top right of the mark. For example, Chime owns a pending trademark application for “America’s #1 Choice for Banking,” so the below is a good example of ™ use with that slogan:

America’s #1 Choice for BankingTM

 

3.     Make the Chime Trademarks stand out from surrounding text.
Whenever using a Chime trademark in a sentence or when surrounded by other text, it should stand out from other wording either by displayed in:

  • Bold font 
    • All capital letters (e.g. CHIME)
  • Title Case
  • A different color font
  • Larger Font; or, if none of the foregoing is possible due to spacing or design concerns:
  • Italicized Font

Bad Example: Chime helps unlock financial progress for its members.

The hierarchy of preference for slogan callouts is below.

  1. (Italics and/or bold or different color) + Title Case + ™ or ®
    Chime® helps Unlock Financial Progress® for its members.
  2. (Italics and/or bold or different color) + ™ or ®
    Chime® helps unlock financial progress® for its members.
  3. Title Case + ™ or ®
    Chime® helps Unlock Financial Progress® for its members.
  4. (Italics and/or bold or different color) + Title Case
    Chime® helps Unlock Financial Progress for its members.
  5. Italics and/or bold or different color
    Chime® helps unlock financial progress for its members.
  6. Minimum call out — Title Case
    Chime® helps Unlock Financial Progress for its members.

Third-Party Must NOT:

  1. Alter the Chime logo (such as displaying it in a color other than Chime green or white or by presenting it in a different font) or combine any third party’s logo with the Chime logo without express permission from Chime.
  2. Use any Chime Trademark in a generic or non-trademark manner. It should be clear that slogans are being used as trademarks (i.e., as a way for consumers to identify services coming from one organization), and that any trademarks, including product names, are referred to as adjectives and not nouns or verbs.

For example, because Chime owns a trademark registration for Banking The Way It Should Be®, the following sentence should NOT be used:

“Our members love how Chime provides banking the way it should be, without hidden fees.”

As another example, because Chime owns a registration for SpotMe®, the following sentence should NOT be used:

“Chime can spot me $20 so I don’t overdraft.”

Trademark Infringement Complaints

For any complaints regarding trademark infringement occurring in a Chime member’s profile, please contact [email protected] with the following information:

  1. The trademark alleged to be infringed, including registration number(s) if applicable;
  2. If you do not have a valid trademark registration, a link to your current use of the mark and attestation of use prior to that of the alleged infringer;
  3. The profile image alleged to be infringing; and
  4. A certification that you are the trademark owner or an authorized representative for the trademark owner.

Copyrights

Chime’s brand is also protected under copyright law. Chime Financial, Inc. owns copyrights in all of its original illustrations and website content. Chime owns several copyright registrations for its unique branding designs and its Dollars & Sense® Card Game, including Reg. Nos. Copyright Policy & DMCA Complaint Procedure

(a) Chime respects the intellectual property rights of others and expects you to do the same. Accordingly, we will respond to notices of alleged copyright infringement that comply with applicable law. If you believe any materials accessible on or through the Services (as defined in Chime’s User Agreement) infringe your copyright, you may request removal of those materials (or access to them) from the Services by submitting written notification to our Copyright Agent (designated below).

(b) In accordance with the Digital Millennium Copyright Act of 1998, (17 U.S.C. § 512) (“DMCA”) the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, the written notice (the “DMCA Notice”) must include substantially the following:

(i)  your full legal name, telephone number, and email address;

(ii)  identification of the copyrighted work you believe to have been infringed or, if the claim involves multiple works on the Services, a representative list of such works;

(iii)  identification of the material you believe to be infringing in a sufficiently precise manner to allow us to locate that material (e.g., a website link);

(iv)  a statement by that you have a good faith belief that the disputed use has not been authorized by the copyright owner, its agent, or the law;

(v)  a statement by you made under penalty of perjury, that the information in your notice is accurate, that you are the copyright owner or authorized to act on the copyright owner’s behalf; and

(vi) your electronic or physical signature or the electronic or physical signature of the person authorized to act on your behalf.

(c) Our designated Copyright Agent to receive DMCA Notice is: [email protected].

(d) If you fail to comply with all of the requirements of Section 512(c)(3) of the DMCA, your DMCA Notice may not be effective. Please be aware that if you knowingly materially misrepresent that material or activity on the Services is infringing your copyright, you may be held liable for damages (including costs and attorneys’ fees) under Section 512(f) of the DMCA.

(e) Users who receive multiple copyright complaints against them related to their use of the Services may be subject to termination of their ability to upload content.
